Footpath Fall Leads to €25,000 Award

A 45  year old housewife, who suffered a fractured ankle when she was caused to trip and fall on a public pavement has recovered damages of €25,000 against a local authority. The client instructed Moloney & Company Solicitors to act on her behalf against the local authority claiming they were negligent in repairing a footpath. Due to the repair work which was done poorly by the local authority’s workmen, a raised lip was left on the foot path which was a hazard. This caused the client to fall. Moloney & Co. Solicitors immediately instructed a consultant litigation engineer to attend at the site of the accident and prepare a liability report. The engineer took photographs, measured the lip and concluded that the lip was a hazard. The insurance company for the local authority subsequently accepted liability and the case was subsequently settled by them for €25,000.
