Unfairly Dismissed Cinema Employee Awarded €8,000 by Rights Commissioner

A cinema worker who was employed for in excess of 4 years by a cinema and who was dismissed for alleged poor performance has been awarded €8,000 by a Rights Commissioner.

The worker who was dismissed by the company after they alleged that he had not complied with company policy, instructed Moloney & Company Solicitors to make a complaint to the Employment Appeals Tribunal for unfair dismissal. The case came before a Rights Commissioner and after hearing submissions on behalf of the employee by Liam Moloney, Solicitor and from the company, the Commissioner issued a written decision awarding the employee €8,000.

The Commisoner held that the dismissal was unfair and in breach of natural justice. €6,000 was awarded under the Unfair Dismissals Act and €2,000 was awarded under the Working Time Act. The employee alleged that he had worked excessive hours and had not been provided with proper work breaks as is required by the Working Time Act. The Commissioner accepted his evidence and found that the company had not complied with its obligations under the act.
