			<content:encoded><![CDATA[<p>The Injuries Board measures the level of compensation for people who have sustained personal injuries in road, work and public place accidents.</p>
<p>It can only deal with cases where there is no dispute on liability. The Board relies solelynon medical reports furnished to them as they never hear from claimants as to how their injuries have affected them.</p>
<p>All personal injury claims (except medical negligence claims) must be lodged with the Injuries Board within two years from the date of the accident. A form is completed by your Solicitor and lodged with the Board together with a medical report and a cheque for<br />
€45.00. The Injuries Board then forward a copy of the application to the respondents and/ or their insurance company requesting their consent to the Board making an assessment of damages.</p>
<p>If consent is given by the other side for an assessment to take place, the Board will have their own panel of doctors to assess the claimant’s injuries. If an objection is made to the Board by the respondents, the Board will issue an Authorisation which allows the<br />
claimant to issue legal proceedings through the Court system against the respondent.</p>
<p>The Injuries Board do not pay claimants legal fees but do cover out of pocket expenses.</p>

<p>Pleural thickening – can be disabling or produce significant physical symptoms.</p>
<p>Asbestosis – progressive crippling respiratory disease.</p>
<p>Lung cancer &#8211;  in very limited circumstances only.</p>
<p>Pleural plaque – changes in the lung showing evidence of asbestos exposure which can be seen on x-rays.  They are evidence of exposure to asbestos and of pathological change caused by it.   They can indicate that the sufferer is at a small, but none the less at a real risk of developing a more serious asbestos related condition.</p>
<p>Some conditions associated with asbestos can also have other causes.   E.g. lung cancer, which is associated with smoking, so it may be possible to prove that lung cancer was caused by asbestos but only in very limited circumstances.</p>
<p>It is important to stress that by no means everyone who has been exposed to asbestos dust – even in large quantities will develop an asbestos – related condition.</p>
<p>In Irish Law an asbestos victim must establish that their condition has been caused by negligence on the part of their employers or someone else.</p>
<p><strong>Defunct employers </strong></p>
<p>Even if your employers have gone out of business or otherwise have ceased to exist it may still be possible to pursue a claim for compensation against them or their insurers.  </p>

<p>In Ireland a personal injury compensation claim for an asbestos related disease must be started within 2 years from the date when the person suffering from the condition became aware of the diagnosis.  </p>
<p>In fatal cases a claim must be commenced by the personal representative of the Deceased person within 2 years of the date of death, or within 2 years from the date the Deceased’s family became aware that the cause of death was due to asbestos exposure.  It is important that legal advice about making a claim is sought without delay.</p>

<p>There are different types of asbestos related diseases and each condition varies in severity.  The conditions include plural plaques, plural thickening, mesothelioma, lung cancer and asbestosis.</p>
<p>Asbestosis is sometimes used as a general term for any asbestos related disease or asbestos related illness.  It is very important to establish from the outset which asbestos related illness has been diagnosed.</p>
<p>Exposure to asbestos has been recognised as an occupational health hazard since early 1900.   As well as those who have been exposed to asbestos at work, family members and others living with anyone employed in an asbestos contaminated work place may have an increased risk of developing the fatal asbestos related cancer, mesothelioma.  <strong>Risk arises from exposure to asbestos dust brought home on clothing and hair by a worker who has been exposed to asbestos.</strong></p>
<p><strong> </strong></p>
<p>The first compensation claims against asbestos manufacturers were in the mid 1920’s.  Since then many compensation claims have been made against asbestos manufacturers and employer for failing to implement safety measures as soon as the link between asbestos exposure and diseases such as asbestosis and mesothelioma became known.   Regardless of which asbestos related condition has been diagnosed, if it can be proven that it was caused by exposure to asbestos by a negligent party then it may be possible to make a personal injury claim for compensation.</p>
