Accidents in Public Places

What is a Public Liability Claim?
If you have an accident or suffer a personal injury whilst on public property which was not your fault then you may be entitled to make a personal injury compensation claim.
The person or company owning and/or responsible for maintaining the public area should have taken out public liability insurance cover to compensate members of the public for any injury they sustain whilst on the property caused by their negligence, therefore your personal injury claim for compensation would be made against that insurance policy.

- Slips, trips and falls in supermarkets, shopping centres, car parks and restaurants.

What should I do now that I have had an accident in a public place?
- To make a successful public liability compensation claim you would need to prove that another person was responsible for your personal injury (in this case the owner of the property where your accident happened).
- To help your case you should report the accident to the staff or owner at the time, make a note of your accident in the accident book if possible, take names and addresses of witnesses to the accident and if possible take photographs of the area where the accident took place.

Road Traffic Accidents
If you are unfortunate enough to be involved in a Road Traffic Accident, which was not your fault, and if you suffered injuries you will be entitled to make a personal injury compensation claim.
If you are a passenger in car, van, bus or coach which was involved in a collision, your personal injury compensation claim would be made against the insurance company of the person responsible for the accident, whether that is the driver of the vehicle you are travelling in or a third party driver (or both if necessary).
If you are a pedestrian, a motor cyclist, a pedal cyclist or a driver your personal injury claim would be made against the insurance company of the person driving the vehicle which struck you.

- Immediately report the accident to the relevant local authority and keep a record of the person you speak to.
- Keep a diary of all of the relevant dates pertaining to the accident itself.
- Take names and addresses and relevant contact numbers of any witnesses to the accident so that these witnesses can be contacted very soon after the accident by your Solicitor to take a witness statement.
If at all possible secure a photograph of the accident location together with photographs of any injuries sustained by you.

There are strict obligations on employers under the Health & Safety Acts together with other legislation to ensure that employees have a safe system of work and that employees are properly trained in the tasks that they are carrying out and that they are provided with proper equipment in the course of their employment.
