Industrial disease claims in Ireland
Industrial disease is a medical condition contracted as a result of an unsatisfactory working environment. The term is used for a wide range of medical conditions including injuries* to the skin, respiratory system and muscles, nerves and tendons. These injuries* can be caused as a result of an employer’s failure to comply with health and safety regulations, failure to provide employees with a safe system of work and a safe place of work as is required under the Safety, Health & Welfare at Work Act 2005.
Compensation claims involving industrial diseases are often a lot more difficult to pursue than other types of personal injury claims*. The exposure which caused the illness could have occurred a long time ago and expert evidence to prove a link between the illness and working conditions may be required.
